IMPORTANT INFORMATION REGARDING A MAJOR CHANGE IN APPLYING FOR PLANNING PERMISSION

Communities and Local Government is launching a standard planning application form in England.

The Standard Planning Application Form (1APP) will replace all existing types of planning application forms (except minerals) within England. This represents the biggest change to the planning system in recent years and a significant step forward in simplifying the planning system.

Currently Local Planning Authorities (LPAs) each produce their own planning application forms. The forms can differ dramatically – an inconsistency in the planning process which often leads to confusion.

1APP will end these discrepancies by ensuring the same information will be requested by every LPA in England.

This will make the planning system clearer for planning professionals and citizens alike and should result in major efficiency savings for LPAs.

The standard planning application form will be available online via the Planning Portal as well as in a paper format from LPAs.

Timescales

The roll-out of 1APP commenced in March and will end on the 6th April 2008 when the standard application form will become the only legal way of submitting a planning application within England (except for minerals). Applications received after this date on the old type forms will not be validated and returned to the applicant.

Further more, any application that is invalid before the 6th of April 2008, if not returned before that date and subsequently validated before that date will be returned to the applicant if the application forms do not comply to the 1App specification.

Making a planning application

There are a number of different forms, plans and maps which need to be provided or completed in support of an application for planning permission.

Please note that any electronic submissions should not exceed 5mb per file. Any file that does exceed this limit will be rejected and we will be unable to validate or register your application and that will cause a delay in the decision being issued.

Obtaining planning application forms:
Copies of forms can be downloaded from the web site as pdf documents from this link here
Alternatively, they can be obtained from Gateway (within the Civic Centre, hours are 9 to 5:30pm Monday to Friday) or by telephoning the Development control office on 023 8083 2603 (office hours are 8.30am to 5.30pm Monday to Wednesday, 8.30am to 7.00pm Thursdays and 8.30am to 4:30pm on Fridays).

Obtaining planning advice:
Planning advice can also be obtained by visiting Gateway or by telephoning the Development control office on 023 8083 2603. Appointments to meet with a Duty Planning Officer at Gateway to obtain planning advice can be made at Gateway (or also by telephoning the Development control office)

If you are not sure whether you need to obtain planning permission or not?:
There is a planning permission enquiry form available from the documents listed. This enquiry form can be displayed and printed. You will need to answer the questions listed regarding your proposed development. Please give as much detail as possible with relevant measurements in metric only. The enquiry form can then be posted or faxed to the Duty Planning Officer (contact details are on the form). The Duty Planning Officer will endeavour to answer your enquiry in writing within 15 working days.

Planning application checklist:

A complete planning application should include the following:

- 3 (Three) completed copies of the application form (please ensure that you have signed and dated each copy).
- A completed Certificate Under Article 12A, which is a certificate of ownership.
- 3 (Three) copies of a standard Ordnance Survey site location map of not less than 1:1250 scale, with a red line showing the proposed development site. Ordnance Survey maps (site location maps) can be supplied at Gateway. The cost for the 5 maps is £20.00, (a small amount of this is an administration charge but the total cost includes a copyright fee which is returned to Ordnance Survey).
- 3 (Three) copies of each plan(s). Plans should include existing and proposed annotated floor and elevational views of a recognised scale such as 1:50 or 1:100 and dimensioned in metric only. Plans that are not to the standard required will be returned and the application invalidated.
- The necessary planning fee (please contact the office if you have problems calculating your fee).

Applications for commercial/industrial properties:
If your application relates to either a commercial or industrial property, please also include 5 completed copies of the Part II application form (in addition) to the Part 1 form and related information requested above.

Circular 01/06 (Communities and Local Government): Guidance on Changes to the Development Control System

Design and Access Statements will be required except for: a material change in the use of land or buildings, unless it also involves operational development; engineering or mining operations; or development of an existing dwelling house, or within its curtilage for any purpose incidental to its enjoyment, unless any part of the dwelling house or its curtilage is within a designated conservation area, area of outstanding natural beauty or site of special scientific interest.

The guidance contained in this Circular relates to England only. A further Circular will be issued when the measures are commenced in relation to Wales. References in this Circular to the “2004 Act” are to the Planning and Compulsory Purchase Act 2004. References to the “1990 Act” are to the Town and Country Planning Act 1990. References to the “Listed Buildings Act” are to the Planning (Listed Buildings and Conservation Areas) Act 1990. References to the GDPO are to the Town and Country Planning (General Development Procedure) Order 1995 and references to the “Listed Buildings Regulations” to the Planning (Listed Buildings and Conservation Areas) Regulations 1990.

Section 42 of the 2004 Act substitutes a new section 62 of the 1990 Act and amends section 10 of the Listed Buildings Act so as to provide that a statement covering design concepts and principles and access issues is submitted with an application for planning permission and listed building consent. Section 42 also inserts a new section 327A into the 1990 Act, which prohibits, among other things, a local planning authority from entertaining an application unless it is accompanied by a design statement and an access statement, where required.

Incomplete applications:
If an incomplete application is received, the planning application will become invalid and will not be considered until the missing information is received. If this information is not received, the full application will be returned with the fee.

How long will it take to reach a decision?
All endeavours will be made to reach a decision within 8 weeks. Your co-operation in providing the correct information at the time of submission, will help us to speed up this process.

Viewing and commenting on Planning Applications

Service bulletin: 26th of June. Our large format scanner is still not working properly and we are unable to scan plans larger that A3. Therefore until further notice, any current applications that have these large plans, will only be viewable in Gateway Reception area at the Civic Centre.

PLEASE NOTE: Not all applications have associated documents, e.g. plans available. Only those applications from approximately December 2007 may be available. There are plans to increase this availability to all applications when time and resources allow.

Service Status as from 23rd April 2008: We are experiencing issues with our large scanner and for the present time, some plans will not be available on-line.

There is a serious error showing all associated documents. If you experience these errors please try again later as we working with our software suppliers to resolve this issue.

In the meantime you can visit Gateway at the Civic Centre between 8.30am to 5.30pm (7.30pm 0n Thursdays) to view copies of current applications.
