Children in entertainment and performance

Many children enjoy performing or taking part in a paid activity such as paid modelling or sport. However, laws exist which are designed to protect children’s health, welfare and education and prevent them from being exploited.

The law applies to all children from birth until completion of compulsory schooling (last Friday in June, during the school year in which the child reaches the age of 16).

Children in entertainment and performance FAQs

1. What type of performances need a licence?

Any performance:

• At a licensed premises or a registered club

• If taking part in a performance which is to be broadcast (includes performing on stage, TV, filming, modelling)

• If the child is paid

• If absence from school is required

• If production directed in any way

• Working in paid/professional sport

2. What types of performances do not need a licence?

A child may perform without a licence for up to four days, but only if:

• It is unpaid

• No absence from school is required

• The child has not performed in the previous six months.

Performances arranged by schools, scouts, guides, youth clubs etc are exempt from licensing and the Local Authority need not be notified.

However, the rule on absence from school still applies and therefore if a child is absent from school for rehearsals or performances, then they must be licensed.

3. Who applies for the licence?

Performances - the person responsible for production.

Modelling - the person who proposes to engage the child.

Paid Sporting Activity- the person responsible for organising the event.

4. When must the licence application be made?

An application should be submitted 21 days before the performance takes place. If a licence is requested at short notice, every effort will be made to oblige but authorisation cannot be guaranteed.
