The Panel noted that Councillor Harris was in attendance as a nominated substitute for Councillor Norris in accordance with Council procedure Rule 4.3.

RESOLVED that the Minutes of the meeting held on 1st September

2010 be signed as a correct record.  (Copy of the minutes circulated with the agenda and appended to the signed minutes).

 

19.

Exclusion Of The Press And Public

Chair to move that in accordance with the Council's Constitution, specifically the Access to Information Procedure Rules contained within the Constitution, the press and public be excluded from the meeting in respect of item 6 based on Categories 1 and 2 of paragraph 10.4 of the Access to Information Procedure Rules. The information contained therein is potentially exempt as it relates to individual personal details and information held under the Data Protection Act 1998. Having applied the public interest test it is not appropriate to disclose this information as the individuals' legal expectation of privacy outweighs the public interest in the exempt information.

Minutes:

RESOLVED that the press and public, unless otherwise excluded by Category 4 of that paragraph 10.4 of the Council’s Access to Information Procedure Rules, be excluded from the meeting in respect of Minute No 20 and be invited to return immediately following private session at which time the matter be determined and the decision of the Panel be announced.

Application For A Sex Shop Licence - The Adult Shop, 90 Howard Road

To consider a report of the Solicitor to the Council concerning an application for a sex shop licence in respect of the Adult Gift Shop, 90 Howard Road, attached.

The Sub-Committee considered the confidential report of the Solicitor to the Council regarding an application for a sex shop licence in respect of the Adult Gift Shop, 90 Howard Road, attached.  (Copy of report circulated with agenda and appended to signed minutes).

 

Mr Hale (Applicant) and Mr Grey (Counsel for the Applicant) were present and with the consent of the Chair addressed the meeting.

 

The Sub-Committee considered the report in confidential session in accordance with Category 4 of Paragraph 10.4 of the Council’s Access to Information Procedure Rules

 

RESOLVED that the application for a sex shop licence in respect of the Adult Gift Shop, 90 Howard Road, be granted subject to the Council’s standard conditions for sex establishments and the following special conditions:-

 

(i)  Conditions 1 to 4 as set out in the report; and

(ii)  an amendment of the standard conditions regarding opening hours be permitted to ensure trading hours be the same as the other sex shops currently licensed by the City Council – 09.00 to 20.00 Monday to Saturday with no trading permitted on public holidays.

 

REASON FOR THE DECISION

 

There was no compelling evidence presented to the Sub-Committee that would justify refusal of the application for renewal of the licence.

 

The Sub-Committee stressed that any breach of conditions would be viewed very seriously in the future, particularly that relating to any person not properly authorised to be involved with the business.
