Exclusion Of The Press And Public At a predetermined point during the consideration of all items the Sub-Committee may move into private session in order to receive legal advice when determining issues. The press and the public, unless otherwise excluded by the Licensing Act 2003 (Hearings) Regulations 2005, will be invited to return immediately following that private session at which time the matter will be determined and the decision of the Sub-Committee will be announced. Minutes:
RESOLVED that in accordance with the Licensing Act 2003 (Hearings) Regulations 2005 that the press and public be excluded at a predetermined point whilst the Sub-Committee reach its decisions.

Report of the Head of Legal and Democratic Services, detailing an application for a premises licence in respect of Co-op, 125 Foundry Lane, Southampton, Hampshire, SO15 3GF, attached.
Minutes: The hearing was delayed for ten minutes to allow for residents to attend. The Sub-Committee then determined to hear the application despite the non-attendance of those objecting.
The Sub-Committee considered the application for a premises licence in respect of Co-op, 125 Foundry Lane, Southampton, SO1 3GF. (Copy of the report circulated with the agenda and appended to signed minutes).
Mr Lewis, Manager, Co-op and Mr Wallsgrove (Solicitor) were present and with the consent of the Chair, addressed the meeting.
The Sub-Committee considered the decision in confidential session in accordance with the Licensing Act 2003 (Hearings) Regulations 2005.
RESOLVED that the application for a premises licence be granted, subject to:-
(i) the agreed additional conditions as set out in the report ; and (ii) the agreed reduction of trading hours from 23h00 to 22h00.
REASONS
The Sub-Committee considered very carefully the application for a premises licence at the Co-op and gave due regard to the Licensing Act 2003, the Licensing Objectives, statutory guidance, the adopted statement of Licensing Policy, Human Rights legislation and all the evidence submitted, both written and given orally today.
The Sub-Committee noted that the premises licence holder had co-operated with the police and that all the conditions suggested by the police had been agreed. In addition, the reduction of hours from 23h00 to 22h00 had also been agreed. The agreement reached, lead to no formal representation from Hampshire Constabulary or any other responsible authority.
The Sub-Committee considered very carefully the evidence of the residents with regards to the potential for nuisance and crime and disorder and was satisfied that in all the circumstances, the issues and concerns raised should be satisfactorily addressed by the policies and practices of the company.
It was noted that the existing premises licence for a public house at the premises which had generated the residents’ concerns was a different premises to that now proposed, given that alcohol would not be consumed on the premises. The concerns of residents had also been addressed by the provision of comprehensive CCTV systems covering both internal and external areas which would be visible to staff on duty. The Sub-Committee was also reassured by the level and extent of training for those making alcohol sales at the premises as well as the Challenge 25 policy to be adopted.
Residents could be reassured by the review process which would enable any problems/issues that might arise in the future to be addressed. |
