Pavement parking

Pavement parking can cause a range of issues for road and footway users, as well as potentially causing damage to kerbs and services running beneath the footway.

It is illegal to drive over the pavement with the exception of accessing a driveway via a dropped kerb. The Police have powers to take action against anyone found doing so.

Enforcement by Parking Services

If there are parking restrictions i.e. double yellow lines it is illegal to park on the road. This also applies to parking on an adjacent footway. Parking in such cases would be a contravention of the restrictions, making the driver liable to a Penalty Charge Notice.

Police Enforcement

Any potential intervention by the Police would depend on their view as to whether the footway is being obstructed i.e. for pedestrians with prams or wheelchairs.

There is a range of highway legislation prohibiting obstruction that can then be applied:

  • Section 137 of Highways Act 1980
  • Section 28 of Town Police Clauses Act 1847
  • Regulation 103 of the Road Vehicles (Construction and Use) Regulations 1986
  • Section 22 of the Road Traffic Act 1988
