Amendment to size criteria for sharing a bedroom

From 1 April 2017 the Housing Benefit regulations have been amended to allow an extra bedroom in the following circumstances:
  • When a disabled child/ disabled non dependant requires and receives overnight care from a non- resident carer
  • When a couple are unable to share a room because of their disabilities

Disabled child/ non dependant requires and receives overnight care from non- resident carer

In order to qualify for the extra bedroom the disabled child/ non- dependant requires and receives overnight care on a regular basis from a non- resident carer or team of carers.

The additional bedroom will be allowed if you are able to demonstrate that:

  • Care has been arranged
  • A spare bedroom is available for carer (team of carers)
  • An extra bedroom has not already been provided for a non- resident overnight carer (or team of carers) in the same household

In addition the disabled child/ non- dependant must receive one of the following:

  • Middle or higher rate of DLA Care
  • Attendance Allowance
  • Daily Living component of PiP
  • Armed Forces Independence Payment

Couples unable to share because of disability

To determine if you cannot share a room with your partner we will consider the following:

  • Are you able to share a room in spite of physical disabilities? This may mean you have single beds in one bedroom.
  • Is there a physical disability that prevents you from sharing a bedroom, for example: related to medical equipment and therefore insufficient space for two single beds?

In addition to the above you or your partner must receive one of the following:

  • Middle or higher rate of DLA Care
  • Attendance Allowance
  • Daily Living component of PiP
  • Armed Forces Independence Payment

Identifying cases

It is not possible to easily identify cases that will qualify for the additional bedroom under this change to legislation.

As a result we are asking for support staff, advice agencies and landlord to let us know if they are aware of any cases where this additional bedroom can be awarded.
