Apologies and Changes in Panel Membership (If Any)

To note any changes in membership of the Panel made in accordance with Council Procedure Rule 4.3.

Minutes:

It was noted that following receipt of the temporary resignation of Councillor Beaurain from the Panel the Director of Legal and Governance acting under delegated powers, had appointed CouncillorHarwood to replace them for the purposes of this meeting.  The Panel also noted the apologies of Councillor Cox.

RESOLVED: that the minutes for the Panel meeting on 1 April 2025 be approved and signed as a correct record.

Report of the Director of Transport and Planning recommending that conditional approval be granted in respect of an application for a proposed development at the above address.

The Panel considered the report of the Director of Transport and Planning in respect of an application for planning permission for the proposed development at the above address recommending that the application be conditionally approved subject to the criteria listed in the report.

 

Change of use from a motorcycle showroom to a takeaway restaurant including fume extraction and bin storage

 

Kristianne Drake and Richard Tooth (local residents/ objecting), Robert Tutton (agent),) and Councillors Kenny and Shields (ward councillors) were present and with the consent of the Chair, addressed the meeting. In addition the Panel noted that a statements had been received, circulated, read and posted online from Mr A May and Lorraine Barter.

 

The presenting officer reported that confirmation from the highway team had been received detailing that there were no objections for this application.

 

It was noted that an additional condition would be required to restrict the use of the premises, set out below.  In addition, officers accepted the Panel request a further condition for noise insulation should be added, as set out below.   

 

Upon being put to the vote, the recommendation to conditionally approve the application with the additional conditions was carried unanimously.

 

 

RESOLVED that planning permission be approved subject to the conditions set out within the report and any additional or amended conditions set out below

 

Changes to conditions

 

8. Restricted Use

 

Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987, as amended, and the Town and Country Planning (General Permitted Development) Order 2015 as amended, or in any other statutory instrument amending, revoking and re-enacting these Orders, the development hereby permitted shall be used as a restaurant with ancillary hot food takeaway and for no other purpose (including any other purpose in Class E) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 as amended by the Town and Country Planning (Use Classes) (Amendment) (England) Order 2005 or in any provision equivalent to that Class in any other statutory instrument revoking and re-enacting that Order).

 

REASON:  In the interests of protecting the character of the area and residential amenity.

 

9. Noise Insulation

 

Prior to first use as a restaurant and ancillary takeaway a scheme for noise insulation between the ground floor commercial use and the first floor residential accommodation shall be installed in accordance with details that have first been submitted to and approved in writing by the local planning authority. Upon implementation of the approved scheme specified in this condition, that scheme shall thereafter be maintained for the lifetime of the development.

 

REASON: to protect the amenities of neighbouring properties in accordance with saved Policy SDP1 and SDP16 of the City of Southampton Local Plan Review (2015).
